TERMS AND CONDITIONS

These Terms & Conditions apply to bookings made directly with Brook Cottage Shepherd Huts. Please read them carefully before making your booking.

If you book through Airbnb or another third-party booking platform, the payment and cancellation arrangements of that platform will also apply to your booking.

1. About your booking

Brook Cottage Shepherd Huts is operated by Brook Cottage Shepherd Huts, company number 16486928, at Yr Erw, Y Ffor, Pwllheli, Gwynedd, LL53 6RR (“we”, “us” or “our”).

When you make a booking with us and we accept it, a contract is formed between us and the person making the booking (“you”).

The person making the booking must be aged 18 or over and is responsible for ensuring that everyone included in the booking complies with these Terms & Conditions.

Our accommodation is adults-only. All guests must be aged 18 or over.

Each shepherd hut accommodates a maximum of two adults.

2. Booking and payment

For direct bookings, a £50 refundable Security Deposit is added to the cost of your stay.

A Deposit of 50% of the total amount payable, including the Security Deposit, is required at the time of booking.

The remaining Balance of 50% is due 28 days before your arrival date.

If you make a booking within 28 days of arrival, the full amount payable, including the Security Deposit, is due at the time of booking.

Your booking is not confirmed until the payment required at the time of booking has been received.

We will send you a reminder before your Balance is due.

If we do not receive the Balance by its due date, we will contact you and give you a reasonable opportunity to make payment. If payment remains outstanding, we may treat your booking as cancelled by you and the cancellation terms in section 8 will apply.

3. Your £50 Security Deposit

For direct bookings, a £50 refundable Security Deposit is included in the total amount payable for your booking.

The Security Deposit is held against damage or breakages caused during your stay and any additional cleaning required because the accommodation has not been left in a reasonably clean and tidy condition.

We will normally return the Security Deposit promptly following your departure and no later than 7 days afterwards, provided no deduction is required.

If we need to make a deduction, we will only deduct an amount that is reasonably necessary to cover the loss or cost incurred and will explain the reason for the deduction.

If the reasonable cost of damage, breakages or additional cleaning exceeds £50, you will be responsible for the additional amount. We will provide reasonable evidence of the costs if requested.

The £50 Security Deposit applies to direct bookings only. Bookings made through third-party platforms may be subject to different arrangements.

4. Arrival, departure and your stay

Your hut will be available from 3pm on your arrival day and you must check out by 10am on your departure day, unless we have agreed otherwise with you.

Please follow the arrival information we send before your stay and let us know your approximate arrival time where requested.

Only the guests included in the booking may stay overnight in the accommodation.

Friends, family or other visitors who are not staying at Brook Cottage Shepherd Huts may not visit the huts or site for parties, BBQs, gatherings or socialising without our prior agreement.

You must use the accommodation, facilities and equipment responsibly and follow any reasonable safety or operating instructions we provide.

You must leave your hut in a reasonably clean and tidy condition and remove your belongings when you leave.

5. Guest information

Brook Cottage Shepherd Huts is adults-only and all guests must be aged 18 or over. We may ask for information reasonably necessary to confirm that guests meet this requirement.

We are also legally required to collect and retain certain information about people staying in our accommodation. We will therefore ask for the information required by applicable law, which includes the nationality of guests and, for some overseas visitors, additional identification and travel information.

Any personal information we collect will be handled in accordance with applicable data protection law and our Privacy Policy.

6. Dogs

Dogs are welcome by prior arrangement in Joan, Susanna and Angharad. Marared and Elen are not dog-friendly.

We normally accept a maximum of one well-behaved small or medium-sized dog, up to 25kg, per dog-friendly hut. If you would like to bring a larger dog, please contact us before booking so that we can discuss whether we can accommodate them.

A charge of £10 per dog per night applies.

Because Brook Cottage is surrounded by livestock fields, dogs must be kept on a lead and under control while outside their hut.

Dogs must not be left unattended in the accommodation at any time.

You are responsible for any damage or additional cleaning caused by your dog.

7. Guest responsibilities and site rules

During your stay, you and anyone included in your booking must behave responsibly and with consideration for us, other guests, our neighbours, livestock and the surrounding environment.

You must not:

  • smoke or vape inside any hut;

  • use candles, tealights or other unauthorised naked flames inside the hut;

  • bring or use illegal substances on the premises;

  • cause unreasonable noise, nuisance, disturbance or damage;

  • interfere with electrical, heating, plumbing or other equipment;

  • exceed the maximum occupancy of two adults per hut; or

  • charge electric cars, e-bikes or other electric vehicles from the accommodation.

Quiet hours are between 9pm and 9am. During these times, please keep noise to a minimum out of consideration for other guests and our neighbours.

For fire safety, electrical safety and insurance reasons, guests must not bring or use their own portable heaters, fans, cooking appliances or other high-load or heat-producing electrical appliances in the huts. This includes air fryers, coffee machines and similar appliances.

Normal small personal electrical items such as mobile phone and laptop chargers, electric toothbrushes and hairdryers are permitted.

Heating, cooling and cooking equipment supplied by us may be used in accordance with any instructions provided.

Wood-burning stoves, fire pits and other fire-related equipment supplied by us must only be used in accordance with the instructions provided and must not be left unattended while lit.

If you or another guest seriously or persistently breaches these rules, behaves in a threatening or abusive manner, creates a safety risk, causes significant disturbance or deliberately damages the accommodation, we may require you to leave.

No refund will normally be payable where we have reasonably had to end a stay because of a serious breach by you or your guests, although any amount retained will be limited to our reasonable losses arising from the breach.

8. Cancellation by you

We understand that sometimes plans change. If you need to cancel your booking, please tell us in writing by email.

Your cancellation takes effect when we receive your cancellation request.

The following maximum cancellation charges apply to direct bookings:

  • If you cancel more than 28 days before arrival, we will refund in full all payments you have made towards your stay.

  • If you cancel 15–28 days before arrival, the maximum cancellation charge is 50% of the cost of your stay, excluding the Security Deposit.

  • If you cancel 14 days or fewer before arrival, the maximum cancellation charge is 100% of the cost of your stay, excluding the Security Deposit.

These are maximum charges. We will take reasonable steps to reduce our loss by making your cancelled dates available for rebooking. If we successfully re-let all or part of your cancelled stay, we will reduce the cancellation charge to reflect the income we receive from the replacement booking and any costs we have saved as a result of your cancellation.

Where this results in a refund becoming due to you, we may deduct a £50 cancellation administration charge to contribute towards the reasonable administrative work involved in dealing with the cancellation, correspondence, readvertising the dates and administering a replacement booking.

We will not recover the same loss twice and will refund any amount due to you following successful re-letting once the replacement booking has been paid for.

If we are only able to re-let part of your cancelled stay, or have to re-let it at a lower price, any refund will take account of the income we have actually recovered and our remaining reasonable loss.

The £50 Security Deposit does not form part of the cancellation charge and will be refunded if your booking is cancelled before your stay.

Any extras that we have not yet purchased or committed to providing will be refunded. If we have already incurred a non-recoverable cost specifically in providing an extra you ordered, we may deduct that reasonable cost from the refund.

We strongly recommend taking out suitable UK travel insurance to protect you if you need to cancel your stay.

9. Changing the dates of your booking

If you wish to change the dates of your stay, please contact us as soon as possible.

We do not normally transfer an existing booking to new dates. Instead, your existing booking will be cancelled and our cancellation terms in section 8 will apply. If you wish to stay on different dates, you can then make a new booking, which will be treated as a separate booking and will have its own payment and cancellation dates.

If your request is made more than 28 days before your original arrival date, when no cancellation charge applies, we may agree to help you move your booking to alternative available dates rather than requiring you to cancel and rebook. Any change is at our discretion and is subject to availability and any difference in price.

This policy ensures that the cancellation terms applying to each booking are based on the dates originally booked.

10. Cancellation or changes by us

In the unlikely event that we are unable to provide your booked accommodation, we will contact you as soon as reasonably possible.

Where appropriate, we may offer you a reasonable alternative, such as another hut or alternative dates, but you do not have to accept it.

If we cancel your stay because we are unable to provide the booked accommodation, we will refund in full all payments you have made to us for the affected booking.

We will not charge an administration fee in these circumstances.

Nothing in these terms affects any additional rights you may have under consumer law where we fail to provide the accommodation or services we have agreed to provide.

11. Events Beyond Our Control

Sometimes events outside either your control or ours may affect your stay. These could include severe weather, flooding, fire, interruption of essential utilities, government restrictions or other events that could not reasonably have been anticipated or avoided.

If we are unable to provide your accommodation

If an event beyond our reasonable control means that we are unable to provide your booked accommodation, we may need to cancel your booking.

If this happens, we will let you know as soon as reasonably possible and refund in full all payments you have made to us for the affected booking.

We will not, however, be responsible for other costs or losses you incur as a result of the cancellation where those costs or losses are outside our reasonable control.

If you are unable to travel

If your accommodation remains available but an event outside your control prevents you from travelling or means that you decide not to travel, our normal cancellation terms will apply.

We strongly recommend that you take out suitable UK travel insurance covering circumstances that may prevent you from taking your booked stay, including illness, travel disruption and other unexpected events.

Nothing in these terms affects any rights you may have where the contract is legally frustrated or any other rights you have under applicable consumer law.

12. Our responsibilities and liability

We will provide your accommodation and our services with reasonable care and skill and in accordance with your booking and applicable consumer law.

If we fail to provide the accommodation or services we have agreed to provide, our responsibility to you will be determined in accordance with applicable consumer law.

We are not responsible for losses that are not foreseeable, losses that result from circumstances outside our reasonable control, or losses that arise because you have failed to comply with these Terms & Conditions or reasonable instructions we have provided.

We are not responsible for loss of or damage to personal belongings unless it results from our negligence or breach of our legal obligations. We recommend that you keep personal belongings secure and ensure that your travel insurance provides appropriate cover.

Nothing in these Terms & Conditions excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or your statutory rights as a consumer.

13. The rural environment

Brook Cottage Shepherd Huts is in a rural location surrounded by farmland, wildlife and natural habitats.

As part of staying in the countryside, you may encounter livestock, wildlife, insects, uneven or wet ground and the sounds and smells associated with farming and the natural environment.

Please take reasonable care when moving around the site, particularly around the lake, woodland, uneven ground and in poor weather.

Fishing, swimming or entering the lake is not permitted.

14. Lost property

You are responsible for your belongings during your stay.

If we find something you have left behind, we will make reasonable efforts to let you know and will normally keep it for one month after your departure.

If you would like to recover an item, you will be responsible for arranging its collection from Brook Cottage Shepherd Huts.

Items that have not been collected within one month may be disposed of or donated.

15. Privacy

We will handle your personal information in accordance with applicable UK data protection law.

We will only use and share your personal information where we have a lawful reason to do so.

Further information about how we use your information and your privacy rights can be found in our Privacy Policy.

16. General

If we do not immediately enforce a provision of these Terms & Conditions, this does not prevent us from enforcing it later.

If any part of these Terms & Conditions is found to be unlawful or unenforceable, the remaining terms will continue to apply.

You may not transfer your booking to another person without our prior agreement.

We may transfer our rights and obligations under your booking to another organisation, provided that doing so does not reduce your rights under the contract.

These Terms & Conditions are governed by the laws of England and Wales. Nothing in this clause prevents you from exercising any rights you may have to bring proceedings in another part of the UK where applicable.

17. Statutory cancellation rights

Because your booking is for accommodation provided on specific dates, the usual statutory 14-day cancellation period for online purchases does not apply.

Your cancellation rights are therefore those set out in these Terms & Conditions together with any rights you have under applicable consumer law.
