TERMS AND CONDITIONS FOR PURCHASES IN THE ONLINE STORE

1. General

  5. Accessing or using the store constitutes acceptance of these Terms and Conditions.

  6. Products purchased through this store are prepared specifically for the date of the Buyer’s stay and form part of the hospitality services provided.

  7. These Terms and Conditions have been written in line with UK consumer protection requirements for perishable goods and date‑specific hospitality services.
     

2. Definitions

 

  • Seller - Brook Cottage Shepherd Huts (as defined above).

  • Buyer - The guest or user purchasing products or services through the store.

  • Product / Service - Any physical or digital item, or services offered by the Seller.
     

3. Ordering Process

 

  1. The Buyer selects product(s) and adds them to the shopping cart.

  2. An order is confirmed once the Buyer provides the required details and full payment.

  3. The Seller reserves the right to approve or decline any order for any reason, including insufficient notice, lack of stock, or payment issues.

  4. Orders must be placed at least 48 hours before arrival, unless otherwise stated. Orders placed with insufficient notice may be declined.
     

4. Prices and Payments

 

  1. Prices are shown in GBP.

  2. Prices include VAT or other applicable taxes.

  3. Payment method: Credit Card only.

  4. In the event of a pricing error or technical issue, the Seller reserves the right to cancel the transaction.

  5. The date and time of the order are determined by the timestamp recorded in the online store system.
     

5. Cancellations and Refunds

 

  1. The Buyer may cancel an order within 3 days of purchase, provided the cancellation is made more than 7 days before the start of their stay.

  2. No refunds will be issued for cancellations made within 7 days of arrival, as products may already have been purchased or prepared.

  3. The following items are non‑refundable once ordered, unless the Buyer cancels more than 7 days before arrival and the Seller has not yet purchased or prepared the item:

  • Hampers

  • Seasonal flowers

  • Any personalised or made-to-order items

 

If the Seller has already purchased or prepared any part of the order, no refund will be issued, regardless of notice period.

 

   4. If the Seller is unable to fulfil an order (e.g., supplier issues), a full refund will be issued.

   5. Refunds (where applicable) will be processed within 7 days to the original payment method unless otherwise agreed.

 

6. Allergies, Dietary Requirements and Substitutions

 

  1. The Seller cannot make substitutions on request or cater for allergies or dietary requirements.

  2. The Buyer is responsible for ensuring the product is suitable for their needs.

  3. The Buyer should contact the Seller before placing an order if they need to confirm suitability.

  4. The Seller may make reasonable substitutions of equal or higher value if specific items are unavailable.

 

7. Delivery, Collection & No‑Shows

 

  1. Products will be delivered to the Buyer’s hut at or before the time of arrival, unless otherwise agreed.

  2. Responsibility for the product transfers to the Buyer once delivery has taken place.

  3. The Seller is not responsible for loss, damage, or spoilage occurring after delivery.

  4. On‑site purchases made during the stay (including additional logs and late check‑out) are subject to availability and are non‑refundable once delivered or confirmed.

  5. No refunds will be issued for no‑shows or delayed arrival, as products will already have been delivered and prepared.

 

8. Responsibility and Service

 

  1. The Seller is responsible only for defects in the product or service supplied.

  2. The Seller is not liable for indirect damages, loss of enjoyment, or inconvenience caused to the Buyer.

 

9. Technical Errors

 

The Seller is not responsible for errors arising from technical faults, including incorrect pricing, stock levels, or system failures. In such cases, the Seller may cancel the order and issue a refund.

 

10. Force Majeure

 

The Seller is not liable for delays or failure to fulfil an order due to events beyond reasonable control, including severe weather, supplier issues, or transport disruption.
 

11. Privacy and Data Protection

 

  1. The Seller will use the Buyer’s personal data solely for order processing.

  2. The Seller complies with GDPR.

12. Governing Law and Jurisdiction

 

  1. These terms are governed by the laws of England and Wales.

  2. Exclusive jurisdiction is vested in the courts of England and Wales.
